Depending on how they are used,  concepts such as fundamental rights , human rights or charters can create confusion.  So in this article we want to tell you the main differences between them, and also make a list of what the fundamental rights are in Spain. According to the RAE , fundamental rights are those “rights declared by the Constitution that enjoy the highest level of protection.” That is to say, these are alienable, inviolable and inalienable rights . And they belong to all people because of their dignity. Thus, any public power, such as the judiciary, must respect them above all things. But also us from our small scale! What is the difference between fundamental rights and human rights? Fundamental rights and human rights differ mainly in one thing: the territory of application.
